STANDARD CONDITIONS & LIMITED WARRANTY

Seller warrants that its block meet applicable ASTM standards. If the block do not meet ASTM standards seller will replace the defective block. SELLER'S AGREEMENT TO REPLACE DEFECTIVE BLOCK IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES EXPRESS, IMPLIED OR STATUTORY.

IF ITEMS COVERED BY WARRANTY ARE NOT REPLACED OR THE DEFECT REMEDIED BY SELLER --- SELLER'S LIABILITY SHALL BE LIMITED TO THE COST OF THE BLOCK. SELLER SHALL IN NO EVENT BE LIABLE FOR BUYER'S LOST PROFITS, GOODWILL, OR OTHER CONSEQUENTIAL DAMAGES.

When beyond curb line delivery is specified, damages to sidewalks, driveways, buildings, trees, lawns, etc. or to our equipment are at buyer's expense.

Delivered block prices cover material delivered in full truck load lots. Any deliveries less than truck load will be subject to an additional handling charge.

Custom-made concrete products are manufactured by careful controlled formulas and procedures. Natural and manufactured aggregates, cements and pigments vary in color and particle shape. NO guarantee of split depth or color uniformity is made or implied in manufacturer's recommendations.

Some color shade variation is normal in split face architectural masonry units; therefore, it is suggested that units be used from several separate pallets as they are placed in the wall. Smooth color units will have more shade differences than split face.

Any claim of defective or discolored units must be made within 48 hours of delivery. If no claim is made, it constitutes acceptance. No adjustments will be made once material is laid in the wall. Adjustments are for material only.

Bauer architectural units include an integral water-repellent: the manufacturer recommends using this same water-repellent in the mortar. HOWEVER, NO GUARANTEE OF WATER IMPERMEABILITY IS MADE. For a total water-repellent job, a good quality masonry water-repellent is recommended to be applied after the project is finished, and the masonry has been cleaned down. The Bauer Company recommends Sure Klean Custom Masonry Cleaner for cleaning and Sure Klean Weather Seal Siloxane WB Concrete or Weather Seal Block-Guard Graffiti Control II, for water repellence.

The Bauer Company will no longer accept returns of architectural block (as well as other types of concrete block and bagged cement products). All sales of these products are final. **NO EXCEPTIONS WILL BE MADE**

On all special ordered architectural orders (Split Face, Split Fluted, Split Rock, etc.) whatever is ordered by the customer must be taken promptly, any portion of these orders not taken will be billed to customer who must remove material from our yard within 30 days or we will dispose of them.
